About this Act
The Banking Regulation Act, 1949 is the core statute governing banking companies in India. It consolidates and amends the law on banking, setting out what business a bank may carry on, how it is capitalised and managed, and how it reports and is inspected.
The Act does not create a new regulator; it gives wide supervisory powers to the Reserve Bank of India, including licensing, inspection, issuing directions, removing managerial persons, superseding boards and imposing penalties. The Central Government also holds powers, such as suspending a bank's business on the Reserve Bank's application and acquiring undertakings.
The index is arranged in Parts rather than Chapters: Part I (preliminary), Part II (business of banking companies), Parts IIA to IIC (management control, supersession, prohibited activities and acquisition), Parts III to IIIB (suspension, winding up and operational matters such as nomination and lockers), Part IV (miscellaneous) and Part V (co-operative banks).
Who it applies to
- Banking companies, including foreign banks operating branches in India
- Co-operative banks, to the extent applied with modifications under Part V
- Directors, chairpersons, managing directors and officers of banks
- Auditors of banking companies and liquidators in bank winding-up proceedings
- Depositors and locker holders, for nomination and claim settlement provisions
